Terms of Service

1About these terms

• Pebflo is provided by TechPebble — [TechPebble’s registered company name], with its registered office at [registered office address], India (“TechPebble”, “we”, “us”).
• If your organisation gave you access, its subscription agreement with TechPebble governs the service between us and your organisation. Where that agreement and these terms conflict, the agreement applies to your organisation. These terms set out what applies to you as an individual user.
• By downloading, signing in to or using Pebflo, you agree to these terms. If you do not agree, do not use Pebflo.
• You must be at least 18 years old to use the apps.

2Your account

• Your organisation creates your account and decides what you can access. It can change your role or deactivate your account at any time.
• Keep your password, one-time codes and phone secure. Do not share your account, and do not sign in as anyone else.
• You are responsible for activity under your account. If you think someone else has used it, tell your organisation or email support@techpebble.com straight away.

3Using Rounds

• Rounds is for your work. Your organisation decides whether location tracking is on for your account and how often your location is recorded. Tracking runs only while your shift is running, as our Privacy Policy explains.
• Clock in and out yourself, at the right time and place. A shift stays open until you or your organisation ends it, so clock out when you finish.
• Record visits, orders, survey answers, photos, videos and signatures accurately and honestly.
• Do not use apps, settings or devices that fake your location, and do not alter records. Rounds flags locations that appear to be faked, and your organisation can see these flags.
• Take photos, videos and signatures only for work, and respect the privacy of the people you meet. Ask before you photograph or record anyone, and follow the rules of the places you visit.
• When you are offline, Rounds saves your work on your phone and uploads it when you reconnect. Stay signed in until your work has uploaded — Rounds will not let you sign out while an upload is still in progress.
• Battery-saving settings on some phones can stop location tracking. Follow your organisation’s instructions for keeping it running.

4Using Rounds HQ

• Rounds HQ is for managers your organisation has authorised.
• Use team information, including location history, only for legitimate work purposes, in line with your organisation’s policies and the law.
• Do not copy, share or keep team members’ personal data beyond what your role needs.

5Rules for everyone

When you use Pebflo, you must not:

• break the law or infringe anyone else’s rights, including privacy and intellectual property rights;
• upload anything unlawful, harmful or misleading, or anything containing malware;
• access, or try to access, data or accounts you are not authorised to use;
• test, scan or probe Pebflo’s security — if you find a vulnerability, report it to support@techpebble.com instead;
• copy, modify, reverse engineer or decompile the apps, except where the law allows it;
• overload or disrupt the service, or access it with bots or scrapers;
• resell Pebflo, or remove any legal notices from it.

6Your organisation’s data

• As between you and TechPebble, the information entered into Pebflo for your organisation belongs to your organisation.
• We handle it under our agreement with your organisation and our Privacy Policy.
• You are responsible for the accuracy of what you enter, and for having the right to upload it.

7Our software and your licence

• TechPebble owns Pebflo, Rounds and Rounds HQ, including their software, design and trademarks.
• While your access is active, we give you a limited, personal, non-exclusive, non-transferable and revocable licence to use the apps for your organisation’s internal business purposes.
• The apps include open-source components, which are licensed under their own terms. They are listed on each app’s About screen.
• If you send us feedback or suggestions, we may use them without any obligation to you.

8Features in testing and changes

• Some Pebflo modules are marked “In testing”. They may be incomplete, and they may change or be withdrawn.
• We improve Pebflo continuously and may add, change or remove features. Where we reasonably can, we will give notice of changes that significantly affect how you use it.
• You may need to install updates to keep using the apps.

9Availability and support

• We work to keep Pebflo available, but we cannot promise it will always be uninterrupted or error-free — for example, during maintenance, network outages or device problems.
• For help, contact your organisation’s Pebflo administrator or email support@techpebble.com.

10Third-party services

Pebflo relies on services from other companies, such as maps, app stores, mobile networks and phone operating systems. Their own terms apply to those services, and we are not responsible for them.

11Suspension and ending access

• Your organisation can end your access at any time, and your access ends if its subscription ends.
• We may suspend or end your access if you break these terms, if it is needed to protect Pebflo or its users, or if the law requires it.
• When your access ends, you must stop using Pebflo. Sections 6, 7, 12, 13 and 14 continue to apply.

12Disclaimers

• To the extent the law allows, Pebflo is provided “as is” and “as available”, without warranties of any kind.
• Locations, distances, working times and other figures are calculated from device data, such as GPS signal and phone settings, and may not be exact. Check anything important before relying on it for decisions such as pay or disciplinary action.

13Limitation of liability

• To the extent the law allows, TechPebble is not liable to you for indirect or consequential loss, or for loss of profits, revenue, data or goodwill.
• To the extent the law allows, our total liability to you under these terms is limited to [₹ amount].
• For organisations, the limits in the subscription agreement apply instead.
• Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud.

14Governing law and disputes

These terms are governed by the laws of India. If a dispute arises, please contact us first so we can try to resolve it. If we cannot, the courts at [city], India, have exclusive jurisdiction.

15Changes to these terms

We may update these terms, and the date at the top will show the latest version. Before significant changes take effect, we will tell you in the apps or through your organisation. If you keep using Pebflo after that, the updated terms apply.

16App store terms

16.1 Apple App Store

If you downloaded Rounds or Rounds HQ from Apple’s App Store, these additional terms apply:

• These terms are between you and TechPebble only, not Apple. TechPebble, not Apple, is solely responsible for the apps and their content.
• Your licence to use the apps is limited to Apple-branded products that you own or control, as permitted by the Usage Rules in Apple’s Media Services Terms and Conditions.
• TechPebble is solely responsible for maintenance and support of the apps. Apple has no obligation to provide any maintenance or support.
• TechPebble is responsible for any product warranties that are not effectively disclaimed. If an app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. The apps are free, and to the extent the law allows, Apple has no other warranty obligation for them.
• TechPebble, not Apple, is responsible for addressing any claims relating to the apps or your use of them, including product liability claims, claims that an app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
• If a third party claims that an app or your use of it infringes their intellectual property rights, TechPebble, not Apple, is responsible for investigating, defending, settling and discharging that claim.
• You confirm that you are not located in a country subject to a United States Government embargo or designated by it as a “terrorist supporting” country, and that you are not on any United States Government list of prohibited or restricted parties.
• You must comply with any third-party terms that apply when you use the apps, such as your mobile data provider’s terms.
• Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.

16.2 Google Play

If you downloaded Rounds or Rounds HQ from Google Play, Google Play’s own Terms of Service also apply to your use of Google Play.
